DREAMer Responsible for Deadly Drunk-Driving Crash Gets Probation

One of President Barack H. Obama’s “DREAMers,” an illegal immigrant brought to the United States as a child and allowed to stay due to the Deferred Action for Childhood Arrivals program, received probation after killing a man in a 2017 drunk-driving crash.

“[Oscar] Guerrero-Olivares and his best friend decided to drive to Colorado Springs for Thanksgiving. Guerrero-Olivares admitted he was behind the wheel when he crashed on I-25 in Fountain. His best friend, and passenger, was killed,” according to a KKTV report.

After being charged with vehicular manslaughter, DUI, and not having insurance, Guerrero-Olivares pleaded guilty to the manslaughter charge in exchange for the other charges being dropped. He was held in the El Paso County Jail in Colorado for 121 days on an Immigration and Customs Enforcement (ICE) detainer before a judge ruled that ICE detainers were not a valid reason to hold illegals in jail. He was released in March, and reappeared in court on Jan 10. sentencing hearing.

“After pleading guilty to vehicular homicide, Guerrero-Olivares faced up to six years in prison,” KKTV said. “At a sentencing hearing on January 10th, the victim’s family asked for mercy and the judge sentenced Guerrero-Olivares to six years of probation.”

So there you have it. Come to American illegally, get drunk, kill someone and endanger the lives of others in a car wreck, and get probation. And then demand citizenship and whine about how unjust America is.

This story, though, has a happy ending.

Guerrero-Olivares was scooped up by ICE just days after his sentencing hearing and taken into custody. According to the KKTV report, which was sympathetic to Guerrero-Olivares, he will likely be deported.

“Records show that Oscar Guerrero-Olivares is being held at a federal facility in Aurora, Colorado. 11 News reached out to ICE to ask why he’s being held and if he is losing his DACA status. No one could provide any answers because all of ICE’s public affairs officers are out of the office for the duration of the government shutdown,” the report said.

Oh well. Speaker of the House Nancy Pelosi (D-Calif.) just rejected a deal that would have extended protections for DACA recipients and reopened the federal government. It appears that because of her unwillingness to compromise, Guerrero-Olivares will have to wait in custody until he finds out his fate.
