Michigan Supreme Court Lets Donald Trump Appear on 2024 Primary Ballot

Former President Donald Trump will appear on Michigan’s primary ballot after the state Supreme Court refused on December 27, 2023 to hear a challenge to his candidacy.
The decision to refuse to hear the case comes a week following the Colorado Supreme Court’s ruling that Trump facilitated an insurrection on January 6, 2021, and is prevented from running for office as outlined by the Constitution. Trump has plans of appealing that ruling to the US Supreme Court, which could rule for all states whether Trump can run for re-election.
Section 3 of the 14th Amendment of the Constitution prevents individuals who participated in an insurrection after swearing an oath to uphold the Constitution. The amendment was ratified three years following the conclusion of the Civil War. This section dealing with insurrectionists was designed to prevent former Confederates from being in office.
Trump’s opponents have contended that the provision bars him from running for reelection due to his actions leading up to and during the January 6 storming of the US Capitol as Congress convenes to certify Joe Biden’s presidential victory. They have filed lawsuits nationwide to attempt to keep Trump off the ballot.
On December 27, 2023, the Michigan Supreme Court announced it would not take up the case, thereby allowing the appeals court ruling to stay in place. In the dissenting opinion, Justice Elizabeth Welch contended that the state’s high court should have listened to the case on the merits. She wrote that she was in agreement with the appeals court’s ruling that the secretary of state can’t prevent candidates from being on the ballot under Section 3.
Trump celebrated the Michigan court’s decision not to handle this case, writing on social media that the attempts to derail his candidacy are a “pathetic gambit to rig the Election.”
The ruling class does not want Trump on the ballot so they’re taking every step possible to derail his candidacy. They know they can’t beat Trump with respect to the arguments so they’ll turn to the most illiberal means of depriving citizens of a legitimate voting option during the 2024 presidential cycle.
