Pro-Gun Organization Files Amicus Brief to Take on Colorado’s Gun Prohibition

The National Sports Shooting Foundation (NSSF) recently filed an amicus brief with the United States Court of Appeals for the 10th Circuit that takes on Colorado’s gun ban that’s based on citizen’s age. 

Colorado Governor Jared Polis signed a law in 2024 that deprives Second Amendment rights to adults below age of 21, by denying their right to legally buy any firearm.

In its amicus brief for Polis v. Rocky Mountain Gun Owners, NSSF contended that Colorado’s law unconstitutionally denies the right to bear arms to adult citizens between the ages of 18 to 20 to legally purchase a firearm at a store. In effect, Colorado’s policy is an age-based gun ban. 

Back in August, US District Court Judge Philip A. Brimmer issued a ruling where he declared that the law was unconstitutional. Colorado’ Governor Jared Polis appealed that decision to the 10th Circuit.

“The Constitution and the courts have been absolutely clear that adults over 18 are free to exercise the full spectrum of all their rights, including their Second Amendment rights,” declared Lawrence G. Keane, NSSF’s Senior Vice President & General Counsel. “Colorado’s insistence of denying the right of a law-abiding young adult to lawfully purchase a firearm, with a completed background check, is blatantly unconstitutional.”

The landmark US Supreme Court Bruen decision ruled that to justify a gun control law that violates gun rights, the state must demonstrate the law is consistent with US history and tradition from the time the US was founded. 

There’s no doubt that the state of Colorado will ignore this Supreme Court decision and the standard it established. The anti-gun Left cares more about scoring political victories and amassing political power, constitutional principles be damned. 

This means gun owners in blue states such as Colorado will have to use the courts to set things right. When dealing with such an unhinged enemy, bold and unconventional measures will have to be pursued to restore our freedoms.
