The National Association for Gun Rights Stands Against the Biden Regime’s Use of Executive Power to Ban Private Firearms Sales and Broaden Red Flag Gun Confiscation Orders

On March 14, 2023 during a press conference in California, President Joe Biden announced an executive order that restricted lawful Americans’ ability to privately sell and buy firearms. Per a White House press release, the executive order will also “increase appropriate use of extreme risk protection (“red flag”) orders” which would grant more judges the power to strip Americans of their right to bear arms in ex-parte hearings. 

“Biden is once again proving that he’s aiming to be the most anti-gun president in our nation’s history,” stated Dudley Brown, the President of the National Association for Gun Rights. “Let’s be honest about what Biden and the Justice Department are doing here – they’re circumventing the Constitution and Congress to impose Universal Gun Registration on all Americans. Biden wants every single gun owning American registered in a federal database so corrupt judges and courts can Red Flag you and steal your guns.”

Per the White House, “…the President is directing the Attorney General to move the U.S. as close to universal background checks as possible without additional legislation” a move that suggests that the Biden regime is working to prohibit the private sale of firearms.

On top of that, the Biden regime announced in the statement that it will be pushing additional states to publicize and encourage red flag gun confiscation orders. 

Currently, 19 states have red flag gun confiscation orders that allow for lawfully-owned firearms to be forcibly seized from lawful Americans without due process. That means flimsy accusations from co-workers, family members, neighbors, and/or current or ex-romantic partners, or roommates are sufficient grounds for such confiscations. 

“Selling a gun to a family member, friend, neighbor, or at a gun show doesn’t make you a dealer in the business of selling firearms – we shouldn’t be forced to use the NICS database to exercise our Second Amendment rights. The reality is this Executive Order will do nothing to stop criminals from buying and selling firearms illegally, but it will entrap otherwise law-abiding Americans and put them on the bad side of the ATF. The unconstitutional NICS database should be abolished, not expanded,” stated Brown.

The Executive Order will also encourage the Federal Trade Commission to “analyze” gun manufacturers and their marketing practices.

“Universal gun registration on all firearms sales, demanding more Red Flag gun confiscation, and federal scrutiny of licensed firearms manufacturers. This is an all-out assault on the Second Amendment and we’re looking into every legislative and legal option to fight back against the most anti-gun president in U.S. history. What part of ‘shall not be infringed’ does Biden not understand?”  Brown said in a concluding remark.

NAGR expressed its opposition to this executive order and called on Congress, States Attorneys General, and legislatures to stand against universal background checks and red flag gun confiscation orders.
