Whistleblower Organization Exposes the ATF for Breaking the Law
The whistleblower organization Empower Oversight cautioned that the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) is preparing the implementation of de facto universal background checks — a move that violates a law passed back in the 1980s.
Back in late August 2023, the ATF published a proposed rule mandating universal background checks, which have routinely died in Congress over the last few decades.
The proposed regulation changes the definition of what constitutes “in the business” of selling guns, expanding the phrase to encompass private citizens who sell even a small amount of firearms yearly.
ATF director Steve Dettelbach commented on the proposed ATF regulation, stating, “This new proposed rule would clarify the circumstances in which a person is ‘engaged in the business’ of dealing in firearms, and thus required to obtain a license and follow the laws Congress has established for firearms dealers.”
In a report published by the Just The News, Empower Oversight asserted that there could be another rule connected to universal background checks, Empower Oversight argued this rule breaks the law and is “unconstitutional.”
Empower Oversight argued that this rule violates a law passed in 1986 where Congress determined that the “business” of selling guns “shall not include a person who makes occasional sales, exchanges, or purchases of firearms for the enhancement of a personal collection or for a hobby, or who sells all or part of his personal collection of firearms.”
On top of that, Empower Oversight argued that the rule also violates the Constitution: “To the extent such a rule prevents the private sale of firearms, it would also clearly violate the Second Amendment to the United States Constitution, which declares that ‘the right of the people to keep and bear Arms, shall not be infringed.’”
Anti-gun tyrants never rest. The gun controllers know that Congress is too gridlocked for any gun control measures to be passed through conventional legislative means.
Instead, they’re turning to unaccountable bureaucracies to tyrannically impose policies that are clearly unconstitutional.
Such moves demonstrate the importance of the pro-gun Right targeting the ATF through defunding campaigns and even moves to abolish it.
This institution simply can’t be allowed to exist.
