Judge Rules CDC Mandate Illegal-
Will two years and counting of continued forced masking when traveling come to an end at last? A federal judge in Florida just struck down on Monday the federal transportation mask mandate forced upon Americans by the CDC and Biden regime alike.
The ruling was enacted by U.S. District Judge Kathryn Kimball Mizelle in Tampa, who was appointed to the court by President Donald Trump. Mizelle stated that the Centers for Disease Control and Prevention did both did not properly justify their decisions nor did they follow proper procedures of the law.
Mizelle’s 59-page ruling declared that the only remedy to the draconian order was to toss it out entirely, specifically citing that many classes of people including the disabled have faced continued discrimination that would not be remedied should the mandate continue.
“Because our system does not permit agencies to act unlawfully even in pursuit of desirable ends, the court declares unlawful and vacates the mask mandate,” she wrote.
Included in Mizelle’s ruling was a section addressing claims that the CDC’s forced mask order is legally justified due to an effort to uphold “sanitation.” She explained that masks objectively do absolutely nothing to sanitize an environment for both the wearer and others, thus making the CDC’s claims erroneous.
“Wearing a mask cleans nothing,” the judge wrote. “At most, it traps virus droplets. But it neither ‘sanitizes’ the person wearing the mask nor ‘sanitizes’ the conveyance.”
Mizelle continued, noting that the CDC does not have the legal “power to act on individuals directly.”
“Wearing a mask—it imposes directly on liberty interests, not the property interests…” Mizelle wrote.
The Justice Department reportedly declined to comment on whether or not the government plans to appeal the ruling.
Republican Florida Gov. Ron DeSantis, who was not directly involved in the case but has gained fame and notoriety alike for his continued battle against various draconian Covid-19 mandates imposed by both the federal government and other politicians in Florida, celebrated the ruling in a statement on Twitter.
“Great to see a federal judge in Florida follow the law and reject the Biden transportation mask mandate. Both airline employees and passengers deserve to have this misery end,” DeSantis wrote on Twitter.
The lawsuit, originally filed in July 2021 by two plaintiffs and the Health Freedom Defense Fund, was described in the judge’s order as a nonprofit group that “opposes laws and regulations that force individuals to submit to the administration of medical products, procedures and devices against their will.”
