Colorado Supreme Court Disqualifies Donald Trump From Running for the Presidency

On December 19, 2023, the Colorado Supreme Court declared that former President Donald Trump can’t run for re-election in 2024 as outlined by the United State Constitution’s insurrection clause and took him off the state’s presidential primary ballot. This ruling will likely head to the US Supreme Court to determine if Trump will remain on the ballot throughout the 2024 presidential cycle.

This Colorado Supreme Court decision marked the first time in history that Section 3 of the 14th Amendment has been invoked to disqualify a candidate from running for the presidency.

“A majority of the court holds that Trump is disqualified from holding the office of president under Section 3 of the 14th Amendment,” the court declared in its 4-3 decision.

The Colorado Supreme ruling overturned a previous ruling from a district court judge who ruled that Trump incited an insurrection during the January 6, 2021 storming of the US Capitol, but said he could not be disqualified from running for the presidency due to how it was unclear that the provision was designed to cover the presidency. 

The Colorado Supreme Court stayed its decision until January 4, 2024 or until the US Supreme Court issued a ruling on the case. 

“We do not reach these conclusions lightly,” the Colorado Supreme Court’s majority wrote in the opinion. “We are mindful of the magnitude and weight of the questions now before us. We are likewise mindful of our solemn duty to apply the law, without fear or favor, and without being swayed by public reaction to the decisions that the law mandates we reach.”

Trump’s legal counsel vowed to appeal any effort to bar him from running for office immediately to the US Supreme Court, which is the court of last resort on all constitutional issues.

Trump’s legal spokeswoman Alina Habba declared in a statement on December 19, “This ruling, issued by the Colorado Supreme Court, attacks the very heart of this nation’s democracy. It will not stand, and we trust that the Supreme Court will reverse this unconstitutional order.”

No doubt about it, this court decision is just the latest attempt by Democrats to prevent Trump from running for office in 2024. Moreover it’s a concerted effort to establish a one-party state by completely disqualifying the opposition. 

We’re reaching an institutional crisis in the US. Such trying times will require brave political actors to step up and assert themselves against diabolical forces who want to destroy the Historic American Nation.

The meek will simply not survive this existential struggle.
