Fifth Circuit Court of Appeals Announces that Case Against Pistol Brace Regulation Has a Good Chance of Succeeding

On August 1, 2023, the Fifth Circuit Court of Appeals ruled that the Firearms Policy Coalition’s claim against the ATF’s pistol brace regulation will likely succeed with Judge Don R. Willett adding that the ATF’s pistol brace regulation likely infringes on the Second Amendment.

The National Foundation for Gun Rights in addition to Texas Gun Rights and Wisconsin Institute for Law and Liberty (WILL) filed a similar lawsuit on June 8, 2023 against the ATF in the Northern District of Texas.

NFGR is pursuing a preliminary injunction to protect its members from the ATF’s enforcement of this regulation for the rest of the litigation period.

“The Fifth Circuit’s ruling is a victory for the Second Amendment and for law-abiding gun owners. The National Foundation for Gun Rights expects a similar ruling to come down in our case in the Northern District of Texas,” stated Hannah Hill, Executive Director of NFGR.

“Hopefully, it is just a matter of time before all of the ATF’s adverse firearms rulings come unraveled in the Justice System. I pray this is the beginning of the end of the ATF legislating by bureaucratic decree,” declared Dudley Brown, President of the National Association for Gun Rights.

NAGR is one of the few organizations that reliably defends the second Amendment at all levels of government.

Moreover it can be relied on to take on unconstitutional agencies such as the ATF, which have to be taken to task for their nefarious political behavior. Without the likes of NAGR in the political mix, the enemies would be able to run roughshod over our freedoms.

Freedom-loving Americans should feel blessed about having an organization like NAGR defending their freedom. There aren’t many organizations who will defend such freedoms so fervently.
