Gun Owners of America Sues New York Over Gun Prohibition for Residents Living Out of State

Gun Owners of America (GOA) and Gun Owners Foundation (GOF) have partnered with Carl Higbie of News Max to file a lawsuit against the New York state government for its refusal to issue gun permits to residents living out of state and for refusing to recognize gun licenses from other states.

Under New York State law, it’s practically impossible for  out-of-state residents to own a firearm within the jurisdiction of the Empire State. The law mandates a permit for merely possessing a firearm. This law stipulates that only residents of New York can acquire a license. John Crump of Ammoland observed that New York’s “law against the possession of firearms by people from outside the State is the strictest in the nation.” In the case, the plaintiffs argue that the New York law violates Americans’ right to keep and bear arms.

“Unsurprisingly, New York’s patently unconstitutional scheme represents an extreme outlier among the 50 states, as Plaintiffs are not aware of any state that similarly has no mechanism for nonresidents to keep or bear arms – by denying nonresidents the ability to apply for permits, by refusing to recognize or grant reciprocity to the out-of-state permits held by nonresidents, and by conditioning mere possession of virtually all firearms on the issuance of an unobtainable permit,” the lawsuit stated. “In contrast, although Connecticut, for example, refuses to recognize other states’ carry licenses, Connecticut allows nonresidents to apply for Connecticut Pistol Permits, should they wish to carry firearms in Connecticut, provided they already have a license to carry from another state. Even California and Hawaii, which do not issue permits to nonresidents, still permit nonresident visitors to transport firearms within the State.”

GOA Senior Vice President Erich Pratt asserted that New York State is ignoring the landmark Bruen Supreme Court by enforcing the gun control law. The state government must demonstrate that the current law is aligned with the original text, tradition, and history of the Second Amendment. 

“The State of New York and its cadre of anti-gun politicians have done everything in their power to weaken and outright ban the Second Amendment within their borders,” Pratt declared. “The Supreme Court has made clear that the right to bear arms extends to the public square, and this right is for all Americans, not just those who are residents of individual states.”

GOA’s work here is revelatory in nature. New York is one of the most anti-gun states in the Union, with Guns & Ammo placing it dead last — 51st place — in its best states for gun owners rankings. 

This means that there are no legislative options for gun owners to use to roll back unconstitutional gun control. In turn, they will have to use the courts to fight back against Gun Control Inc.

Such is the political reality of living in blue states where the right to bear arms is not respected.
