Judge Won’t Throw Out Subway Self-Defense Case Against US Marine Corps Vet Daniel Penny

On January 17, 2024, a judge  rejected a motion by lawyers for Daniel Penny, the United States Marine veteran who choked out deranged assailant Jordan Neely on a New York City subway on May 1, 2023, to throw out the case.

The decision was issued in court January 17. The judge ordered that Penny return to court in late March. His trial is slated to start in fall of 2024.

Penny’s legal counsel Steven Raiser and Thomas Kenniff manifested their disagreement with the judge’s decision.

“While we disagree with the Court’s decision not to dismiss the indictment, we understand that the legal threshold to continue even an ill-conceived prosecution is very low,” Raiser and Kenniff declared in a statement. “We are confident that a jury, aware of Danny’s actions in putting aside his own safety to protect the lives of his fellow riders, will deliver a just verdict. Danny is grateful for the continued prayers and support through this difficult process.”

Penny pleaded not guilty to second-degree manslaughter and criminally negligent homicide in the May 1 death of Neely, a former Michael Jackson impersonator who was yelling at the top of his lungs and panhandling on the Manhattan train, per witnesses.

Penny got him to the ground with the aid of two other passengers and put him in a chokehold for over three minutes. Neely passed out during the scuffle and ended up dying. 

This incident was heavily politicized by the Left who instantly played the race card, since Neely was black while Penny was white. 

In an October court filing, Penny’s lawyers showcased testimony from grand jury witnesses who were on the train on May 1. One of the passengers, the motion noted, was in a state of fright and thought he “was going to die” when Neely approached.

Penny argued that he acted to protect himself and others from Neely, who he perceived as a credible threat. In a video statement that this legal counsel released after the incident, Penny claimed Neely repeatedly said “I’m gonna kill you,” and that he was prepared to die or spend the rest of his life in prison.

Penny’s case is just another case of anarcho-tyranny, where the law-abiding are punished while actual criminals are allowed to get slaps on the wrist. This system is unsustainable and will lead to the eventual institutional decline of the US. 

The Right must do everything possible to restore law & order in this country, lest we want to slip away and fall in the hands of total leftist lunatics.
