Leading Gun Rights Organizations and Two Dozen States File Lawsuit to Stop ATF’s Latest Gun Grab

Some of America’s most prominent gun rights organizations filed a lawsuit earlier this month against the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF’s) latest regulations on pistols with stabilizing braces.  

On February 9, 2023, the National Rifle Association (NRA) filed a federal lawsuit in North Dakota that made the case that the ATF’s latest pistol brace regulation is “arbitrary” and an “abuse of power,” per a Fox News report. 

“The bureau is declaring that they will effectively decide on a case-by-case basis whether a firearm is subject to the NFA. Every American gun owner is in danger of potentially facing felony charges at the whim of these bureaucrats and without any new statute in place,” declared Jason Ouimet, executive director, NRA Institute for Legislative Action. 

25 other states joined the NRA in this lawsuit. West Virginia Attorney General Patrick Morrisey and North Dakota Attorney General Drew Wrigley are leading a coalition that includes Alabama, Alaska, Arkansas, Florida, Georgia, Idaho, Indiana, Iowa, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Montana, Nebraska, New Hampshire, Oklahoma, South Carolina, South Dakota, Tennessee, Utah, Virginia, and Wyoming. 

At the same time, Gun Owners of America (GOA), the Gun Owners Foundation (GOF), and Texas Attorney General Ken Paxton filed a lawsuit against the ATF on the pistol brace regulation, per a Breitbart report. 

GOA said to ZeroHedge that the ATF pistol brace regulation “could result in serious criminal charges for owners of up to 40 million guns if they do not register their braced firearms with ATF. ” 

GOA’s senior vice president, Erich Pratt, said the following to Breitbart:

Millions of Americans are facing a very tight deadline to destroy or register their lawfully owned property under this draconian new rule. We hope the court will hear the pleas of gun owners across the country who will be irrevocably harmed by this rule, and GOA stands ready to fight it at every turn.

It’s good to see the goons at the ATF receive pushback. This unconstitutional agency must face as much pressure as possible. Its very existence constitutes an existential threat to the Second Amendment rights of millions of Americans. The quicker gun rights activists start mounting campaigns of all sizes against it, the quicker we will be towards restoring gun rights in America.
