Pro-Gun Organization Celebrates Victory in Federal Court Over Pistol Brace Case

On October 4, 2023, the National Foundation for Gun Rights (legal arm of the National Association for Gun Rights) came out victorious in federal district court after Northern District of Texas Judge Reed O’Connor granted a preliminary injunction in NFGR’s lawsuit taking on the ATF’s pistol brace regulation.
As a result of this injunction, all members of the National Association for Gun Rights and its state affiliate Texas Gun Rights are shielded from the legal consequences of the ATF’s pistol brace regulation.
“This is a major victory for the Second Amendment and a blow against the ATF’s unconstitutional legislation by bureaucratic rulemaking,” proclaimed Hannah Hill, Executive Director of the National Foundation for Gun Rights. “We want to thank Wisconsin Institute for Law and Liberty, who represented us in this case.”
The ATF’s rule had reclassified pistols equipped with stabilizing braces as short-barreled rifles. Put simply, the ATF was looking to regulate Americans’ gun rights via federal laws that were never designed to be applicable to them and their firearms.
The ATF’s rule greatly broadened the definition of a rifle and imposed potential criminal penalties on millions of Americans without going through a traditional legislative process.
“The ATF has been overstepping their authority for decades,” declared Dudley Brown, president of the National Association for Gun Rights. “We have a legislature who creates our laws, we don’t need a bunch of unelected bureaucratic cowboys at the ATF hijacking Congress’s job.”
The ATF is one of the most insidious of agencies in the US government. As a bureaucracy, its whole goal is to promúlgate gun control policies without going through a legislative process — a complete violation of republican constitutional norms.
Only a principled gun rights organization such as NAGR can be counted on to defend the Second Amendment from all attacks — be they legislative or bureaucratic. NAGR’s work should be commended, especially during a time when Gun Control Inc. is using every underhanded tactic under the sun to undermine gun rights.
