Pro-Gun Organizations and State of Texas Obtain Preliminary Injunction Against Biden Pistol Brace Ban

On the evening of May 31, 2023, Judge Drew B. Tipton issued a preliminary injunction against the Biden Pistol Brace Ban in a lawsuit brought  Gun Owners of America (GOA), the Gun Owners Foundation (GOF), and the State of Texas. This injunction is applicable to all members of Gun Owners of America and individuals working for the State of Texas or its agencies. 

This new ATF regulatory order, which was originally set to go into effect on June 1st, would have made millions of Americans felons overnight if they were caught possessing an unregistered braced firearm. According to some estimates, roughly 40 million of these firearms are currently in the hands of lawful citizens. 

Erich Pratt, GOA’s Senior Vice President, said the following statement:      

This assault on millions of Americans was just the latest example of President Biden trying to weaponize the DOJ against law-abiding gun owners, and we doubt it will be the last. We are incredibly grateful to Judge Tipton for hearing the pleas of our members who were facing serious prosecution simply for owning a piece of plastic – all because of an arbitrary reclassification by the ATF. GOA and our millions of members nationwide will continue to fight back against this rogue anti-gun administration at every turn in defense of our rights.

Sam Paredes, who spoke on behalf of GOF’s board, added:  

While Congress was slow to act on this wide-reaching rule, GOF stepped in to defend the millions of Americans facing legal jeopardy. We are proud to have helped partially halt this rule, and hope it sends a message to anti-gunners hellbent on continuing the assault on the Second Amendment.

Such devotion is why certain legislative projects like Constitutional Carry have become so successful. The Right should study the Second Amendment’s success and emulate the likes of GOA in terms of legislative behavior. These organizations hold the keys to pushing back against the anti-gun Left.
