Thomas Massie Warns About the Dangers of Red Flag Laws

11 Senate Republicans have already shown that they’re willing to sell out gun owners by agreeing to a bipartisan gun control package earlier this week. 

This gun control package features “red flag” gun confiscation orders, more draconian Federal Firearms Licensing (FFL) laws, and more intrusive background checks for individuals ages 18 to 20. 

The red flag gun confiscation order proposal featured in this package has alarmed many pro-Second Amendment advocates. Kentucky Congressman Thomas Massie sounded the alarm on the dangers of red flag laws. 

In a tweet he posted on June 14, 2022, Massie stated “Red Flag laws violate the 5th Amendment to the Constitution:

‘No person shall be … deprived of life, liberty, or property, without due process of law;’”

Red flag laws are one of the most popular anti-Second Amendment proposals that has significant buy-in from both parties in DC. 

Red flag gun confiscation orders grant law enforcement the power to confiscate an individual’s guns if they are perceived to be a threat to themselves or others. All of this is carried out without due process. 

While red flag laws are marketed as a quick fix to mass shootings, gun researcher John Lott has demonstrated that they have very little impact on stopping gun crime. Using data figures from 1970 to 2017, Lott concluded that “A Red Flag laws appear to have had no significant effect on murder, suicide, the number of people killed in mass public shootings, robbery, aggravated assault or burglary. There is some evidence that rape rates rise. These laws apparently do not save lives.”

Moreover, Connecticut passed what would be the nation’s first red flag law in 1999. Despite having this gun control law on the books, it could not stop Adam Lanza from carrying out a horrific slaughter at  Sandy Hook Elementary School in 2012.

Overall, further gun control will not stop mass shootings. Instead, lawmakers will need to bolster school security by letting qualified staff carry firearms, bringing in private security, bolstering mental health programs and/or carrying out tougher disciplinary actions against individuals who manifest anti-social behavior. 

Civilian disarmament is not a solution to what is actually a problem of social decay.
