United States Supreme Court Rejects Injunction Against Illinois “Assault Weapons” Prohibition

On December 14, 2023, the Supreme Court of the United States threw out the writ of injunction request sent to Justice Amy Coney Barrett by the National Association for Gun Rights (NAGR).
In early December, Breitbart News reported that the Supreme Court placed the request on a docket of cases to hear. This request pursued an injunction against enforcement of Illinois’ “assault weapons” prohibition as the appeal process is going through.
NAGR and the other plaintiffs pursued an en banc hearing before the United States Court of Appeals for the Seventh Circuit and an injunction against enforcement of the Protect Illinois Communities Act until the hearing takes place.
The Supreme Court’s Office of the Clerk of Court issued a response to the emergency application by calling attention to how Justice Amy Coney Barrett had ordered a briefing.
On December 14, 2023, Supreme Court ended up rejecting the application for a writ of injunction.
The emergency application was for National Association for Gun Rights v. City of Naperville, Illinois, No. 23A486 in the US Supreme Court.
The courts have a role in fighting gun control, but they’re not a silver bullet for this issue. At the end of the day, gun rights activists will need to use all means at their disposal to restore the Second Amendment. That means lobbying, electioneering, litigation, etc. The courts themselves are still captured by elites so they can’t always be trusted to restore the right to bear arms.
